Der Geltungsbereich
Für die Geschäftsbeziehung zwischen Out Of Line Shop und dem
Besteller gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen
in ihrer zum Zeitpunkt der Bestellung gültigen Fassung. Abweichende Bedingungen
des Bestellers erkennt Out Of Line Shop nicht an, es sei denn, Out Of Line Shop
hätte ausdrücklich schriftlich ihrer Geltung zugestimmt.
Der Vertragsabschluss
Deine Bestellung stellt ein Angebot an uns zum Abschluss eines Kaufvertrages
dar. Wenn Du eine Bestellung bei Out Of Line Shop aufgibst, schicken wir Dir eine
E-Mail, die den Eingang Deiner Bestellung bei uns bestätigt und deren Einzelheiten
aufführt (Bestellbestätigung). Diese Bestellbestätigung stellt
keine Annahme Deines Angebotes dar, sondern soll Dich nur darüber informieren,
dass Deine Bestellung bei uns eingegangen ist. Ein Kaufvertrag kommt erst dann
zu Stande, wenn wir die bestellten Produkte an Dich versenden.
Out Of Line Shop bietet keine Produkte zum Kauf durch Minderjährige an. Auch
unsere Produkte für Kinder können nur von Erwachsenen gekauft werden.
Wichtig: Wir verkaufen unsere Produkte nur in haushaltsüblichen Mengen.
Der Widerruf
Hinsichtlich Musikdateien ist das Widerrufsrecht nach § 312d Abs.
4 Nr. 1 BGB ausgeschlossen, da diese nicht rückstandslos zurückgegeben
werden können. Ebenso besteht kein Widerrufsrecht bei Audio- oder Videoaufzeichnungen(z.G.
CDs, Videokassetten, DVD) oder von Software, sofern die gelieferten Datenträger
von Euch entsiegelt worden sind.
Ansonsten könnt Ihr Eure auf den Vertragsschluss gerichtete Willenserklärung
innerhalb von zwei Wochen ohne Angabe von Gründen schriftlich gegenüber
uns (Anschrift siehe Impressum) widerrufen. Zur Wahrung der Frist genügt
die rechtzeitige Absendung des Widerrufs. Die Frist beginnt mit dieser Belehrung,
bei der Lieferung von Waren jedoch nicht vor deren Eingang bei Euch.
Bei Rücksendung von Ware, deren Bestellwert € 40,- nicht übersteigt, habt Ihr die
Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht.
Anderenfalls ist die Rücksendung kostenfrei, d.h. wir ersetzen euch die Portokosten nach
Eingang der zurück gesendeten, einwandfreien und unbenutzten Ware.
Unfreie Pakete nehmen wir nicht an!
Wichtig
Nehme niemals ein defektes Paket an, denn damit bestätigst Du praktisch
stillschweigend den einwandfreien Erhalt der Ware und kannst in diesem Fall keine
Entschädigung beantragen. Also gegebenenfalls die Annahme verweigern, wenn
das Paket aufgerissen oder beschädigt sein sollte. Bitte ruf uns an und gib
Bescheid, dass Du die Annahme verweigert hast. (Telefonnummer siehe unten).
Darüber hinaus gilt unsere Rücknahmegarantie.
Die Lieferung
Sofern nicht anders vereinbart, erfolgt die Lieferung ab Lager an die
vom Besteller angegebene Lieferadresse.
Falls der Lieferant von Out Of Line Shop trotz vertraglicher Verpflichtung Out
Of Line Shop nicht mit der bestellten Ware beliefert, ist Out Of Line Shop zum
Rücktritt berechtigt. In diesem Fall wird der Besteller unverzüglich
darüber informiert, dass das bestellte Produkt nicht zur Verfügung
steht. Falls nötig, wird der bereits bezahlte Kaufpreis unverzüglich
erstattet.
Teillieferungen
Solltet Ihr wünschen, dass wir Euch Eure Bestellung in mehreren Teillieferungen zuschicken, z.B., weil ein oder mehrere Artikel gerade nicht verfügbar oder noch nicht erschienen sind, so vermerkt dies bitte unter "Kommentar", wenn Ihr Eure Bestellung abschickt. Bitte beachtet, dass wir Euch dann für jede einzelne Lieferung Porto berechnen müssen, und dass auch der Portofreibetrag entfällt. Wenn Ihr dies nicht explizit anders wünscht, verschicken wir Eure Bestellung, wenn alle Waren am Lager sind. Habt Ihr also z.B. einen Artikel in Eurer Bestellung, der erst in einem Monat erscheint, so werden wir auch Eure Bestellung erst dann verschicken.
Die Fälligkeit und die Zahlung, der Verzug
Der Besteller kann den Kaufpreis per Vorauskasse, Nachnahme
(nur bei Versand innerhalb Deutschlands! + Nachnahmegebühren
€ 3,60 und € 2,00 Zahlkartengebühr – erhebt beides leider
die Post) oder Lastschriftverfahren (erst ab der 4. Bestellung möglich!)
zahlen.
Porto und Versandkosten
betragen € 3,99. Ab einem Rechnungswert (ohne Porto) von € 60,00 übernehmen
wir das Porto von € 3,99 (Geltungsbereich nur im Inland!)
Bei Auslandslieferungen wird
das Porto nach Gewicht und Land berechnet.
Bei Ticketbestellungen erfolgt die Zahlung per Vorauskasse. Solltest Du noch zusätzliche Ware aus unserem Shop mitbestellen, dann gelten auch die üblichen Zahlungsoptionen wie Nachnahme (zzgl. NN GebÜhren) oder der Bankeinzug (erst nach der 3. Bestellung).
Porto- und Bearbeitungskosten bei Tickets betragen bei uns einmalig 3,99 Euro pro Order (nicht pro Ticket).
Bei Ticketbestellungen gilt nicht die Portofreigrenze. Sollte deine Bestellung Tickets und weitere Artikel enthalten, so gilt die Portofreigrenze, wie bei uns üblich, erst ab einem Warenwert (ohne Tickets) von 60,00 Euro !
In Kombination mit einer Warenbestellung über 60,00 Euro kannst du damit deine Tickets ohne jegliche Porto- und Bearbeitungskosten bei uns erhalten!
Unannehmlichkeiten
Die bekommst Du dann, wenn Deine Lastschrift nicht eingelöst werden kann,
weil Dein Konto nicht gedeckt ist. Wir müssen Dir dann leider zusätzlich
€ 7,69 an Bankgebühren berechnen!
Wir verschicken grundsätzlich nur eine Mahnung! Wird dann innerhalb der
von uns festgesetzten Frist nicht bezahlt, treten wir die Forderung sofort an
unseren Anwalt ab, der die Forderung für uns eintreibt, und das wird dann
sehr sehr teuer! Also achte bitte darauf, dass Dein Konto immer ausreichend
gedeckt ist!
Bezahlung per Paypal
Wir akzeptieren die Zahlung per Paypal im Out of Line Onlineshop.
Wenn Du Deine Bestellung per Paypal bezahlen möchtest, vergewissere Dich bitte,
dass die e-Mail-Adresse, die Du angibst, die Deines PayPal-Accounts ist.
Wir werden Dir dann eine Bestellungsbestätigung über die Gesamtsumme in Euro plus Porto und Verpackung,
sowie eine PayPal Zahlungsanforderung an Deine e-Mail-Adresse schicken.
Benutze bitte für alle PayPal betreffenden Anfragen und Zahlungsanweisungen die e-Mail-Adresse:

Wichtig: wenn Ihr uns Zahlungen schickt, vergewissert Euch bitte, dass Ihr uns die Gesamtsumme in Euro,
und nicht in einer anderen Währung, schickt. Wir werden keine Zahlungen, die in einer anderen Währung als
in Euro angewiesen werden, annehmen. Eventuelle Kosten für die Rückbuchung einer Zahlung in einer Fremdwährung
übernimmt der Kunde.
Aufrechnung, Zurückbehaltung
Ein Recht zur Aufrechnung steht dem Besteller nur zu, wenn seine Gegenansprüche
rechtskräftig festgestellt oder von dem Out Of Line Shop anerkannt worden
sind. Außerdem ist er zur Ausübung eines Zurückbehaltungsrechts
nur insoweit befugt, als sein Gegenanspruch auf dem gleichen Vertragsverhältnis
beruht.
Der Eigentumsvorbehalt
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung im Eigentum
vom Out Of Line Shop.
Die Mängelhaftung
Offensichtliche Mängel sind von Euch innerhalb von sieben (7)
Tagen nach Erhalt der Ware uns gegenüber (Adresse siehe Impressum) schriftlich
anzuzeigen. Nach Ablauf dieser Frist hat der Kunde keinerlei Ansprüche
mehr wegen offensicht-licher Mängel.
Liegt ein Mangel der Kaufsache vor, kann der Besteller Nacherfüllung (Mängelbeseitigung
oder Ersatzlieferung) verlangen. Schlägt die Nacherfüllung fehl, kann
der Besteller bei einem nicht unerheblichen Mangel vom Vertrag zurücktreten,
den Kaufpreis mindern oder Schadensersatz geltend machen. Die Abtretung dieser
Ansprüche des Bestellers ist ausgeschlossen.
Soweit sich nachstehend nichts anderes ergibt, sind weitergehende Ansprüche
des Bestellers -- gleich aus welchen Rechtsgründen -- ausgeschlossen. Out
Of Line Shop haftet deshalb nicht für Schäden, die nicht am Liefergegenstand
selbst entstanden sind; insbesondere haftet Out Of Line Shop nicht für
entgangenen Gewinn oder für sonstige Vermögensschäden des Bestellers.
Soweit die Haftung vom Out Of Line Shop ausgeschlossen oder beschränkt
ist, gilt dies auch für die persönliche Haftung von Arbeitnehmern,
Vertretern und Erfüllungsgehilfen.
Vorstehende Haftungsbeschränkung gilt nicht, soweit die Schadensursache
auf Vorsatz oder grober Fahrlässigkeit beruht oder ein Personenschaden
vorliegt. Sie gilt ferner dann nicht, wenn der Besteller Ansprüche aus
§§ 1, 4 Produkthaftungsgesetz geltend macht.
Sofern der Out Of Line Shop fahrlässig eine vertragswesentliche Pflicht
verletzt, ist die Ersatzpflicht für Sachschäden auf den typischerweise
entstehenden Schaden beschränkt.
Erfolgt die Nacherfüllung im Wege einer Ersatzlieferung, ist der Besteller
verpflichtet, die zuerst gelieferte Ware innerhalb von 30 Tagen an den Out Of
Line Shop zurückzusenden. Geht die Ware nicht innerhalb dieser Frist beim
Out Of Line Shop ein, ist der Out Of Line Shop berechtigt, Ersatz für die
zuerst gelieferte Ware zu verlangen und diesen von dem zur Zahlung benannten
Zahlungsmittel abzubuchen.
Sofern der Out Of Line Shop eine vetragswesentliche Pflicht verletzt, ist die
Ersatzpflicht für Sachschäden auf den typischerweise entstehenden
Schaden beschränkt.
Die Verjährungsfrist beträgt vierundzwanzig Monate, gerechnet ab
Lieferung.
Erhebung, Verarbeitung und Nutzung von persönlichen Informationen
unserer Kunden
Informationen, die wir von Dir bekommen, helfen uns, das Angebot in
unserem Out Of Line Shop individuell zu gestalten und stetig zu verbessern.
Wir nutzen diese Informationen für die Abwicklung von Bestellungen, die
Lieferung von Waren und das Erbringen von Dienstleistungen Wir verwenden Deine
Informationen auch, um mit Dir über Bestellungen und Produkte zu kommunizieren,
sowie dazu, unsere Datensätze zu aktualisieren und Dein Kundenkonto bei
uns zu unterhalten und zu pflegen.
Anwendbares Recht
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.
Datenschutz
Alle im Zusammenhang mit Dir stehenden Daten, die bei uns abgespeichert
sind, werden streng vertraulich behandelt und nicht an andere Firmen oder Institutionen
weitergegeben.
Gerichtsstand und Erfüllungsort
Der Gerichtsstand ist Berlin. Erfüllungsort für beide Vertragspartner
ist Berlin.
Haftungshinweis: Trotz sorgfältiger inhaltlicher Kontrolle übernehmen

Terms and Conditions Out of Line Shop
General Terms
The following terms and conditions in the current version found on www.outoflineshop.de at the date and time an order is placed are applicable for all business transactions between Out of Line Shop and customer. Out of Line Shop will not accept any diverging terms on part of customer unless these were agreed upon in written form prior to the transaction.
The Deed of Purchase
Your order is an explicit offer from your part to undergo a deed of purchase with our company. When you place an order at Out of Line Shop, we will send you an e-Mail that confirms that we have received it and that will contain all the details of the order you placed. This confirmation does not in itself imply that we accept your offer. It is only there to inform you that your order has been received. A real deed of purchase only comes into effect at the moment we ship the ordered goods to you.
Out of Line Shop does not sell to customers below the legal age to undergo monetary transactions. Even products that are directed at an underage audience may only be purchased by adults.
Please note: we only sell our goods in reasonable quantities.
Cancellation
The cancellation of a transaction contract in regard to audio files is not possible because – according to § 312d, paragraph 4, Nr. 1 BGB – these cannot be returned remnant-free (i.e. without the possibility that customer retains a copy of said file). Returns of audio- and audiovisual recordings (for instance CDs, videotapes, DVDs) are not possible after the factory seal has been broken.
In all other cases, you may revoke your offer of undergoing a purchase contract with us in written form within a time period of two weeks. Said cancellation of your order only has to be sent out within the time limit to make it valid. The time limit legally commences with your acknowledgment of these terms and conditions … in case of physical goods shipped to you it commences upon delivery to you.
The shipping costs of any and all returns whose total value does not exceed € 40.00 and which were not shipped to you in error will have to be covered in full by you. Returns of goods shipped to you in error or whose total value exceeds € 40.00 will be covered by us in that we will return you the shipping fees. WE WILL NOT ACCEPT PARCELS THAT ARE NOT PREPAID.
Please note!
Please do not accept visibly damaged or broken parcels, as with your acceptance, you practically acknowledge that you received the goods in optimal condition and thereby forfeit your eligibility for compensation. Therefore, please reject any and all parcels that have been torn or otherwise visibly damaged and have them be returned to sender. Please call us to inform us that you have not accepted delivery of said parcels (telephone number listed below).
Otherwise, our regular warranty for damaged goods applies.
Delivery
If not otherwise agreed upon, delivery will be made from our warehouse to the delivery address specified by sender.
If any third party supplier fails to supply Out of Line Shop with the goods you ordered, Out of Line Shop is entitled to revoke said order. In such a case, the customer will be informed ASAP that the ordered product is not available. Any advance payments already made for said orders will be returned to customer.
Payment and Default
Customer can make payment for orders he placed by advance payment (bank transfer, PayPal), C.O.D. (Germany only! + € 3.58 C.O.D.- fee and € 2.00 payment fee – both are collected by the Deutsche Post) or account debit (Germany only. Only for registered customers that have placed at least three orders.) We will pay p&p for all orders inside Germany that total up to more than € 60.00. For orders from outside of Germany, postage and payment will be calculated according to country of delivery and weight of parcel.
For ticket orders, we only accept advance payment. In the case that you also order additional items from our shop, we will also accept our other regular forms of payment such as C.O.D. (orders inside Germany, only) or bank collection (orders inside Germany, only.)
Shipping and handling fees are 3,99 € per order (not per ticket!)
Free shipping from 60 € sum total does not apply to orders containing only tickets. Free shipping applies if your order consists of tickets and other items and the sum total of the other items (minus tickets) exceeds 60 €.
Therefore, if you order other items for a sum total exceeding 60€ and add your ticket order to that order, you will also receive the tickets free of charge.
Problems
If we cannot perform an account debit because there are insufficient funds left on your account, we will have to charge an additional € 7.69.
Please note that we will only send out one dunning letter. If we then do not receive your payment within the time period specified by us, we will have to pass the claim on to our attorney for prosecution, which will most probably become very expensive for you. Thus, if you choose payment by bank debit, please make sure your balance will be able to cover the costs.
Using Paypal
We accept Paypal in the Out of Line Onlineshop. If you choose to pay via PayPal, please make sure that the
e-mail-address you give us is the one connected with your PayPal account. We will then send an order
confirmation with the sum total incl. shipping to your country and a PayPal payment request for the sum
total in Euro to the e-Mail-address you specified. Please use the following e-mail-address for all things
regarding PayPal (questions or payments): order@outofline.de.
Please make sure that the sum total you send us is in Euro and not in any other currency.
Payments in any currency other than Euro will be rejected and any fees or costs attached to a payment
rejection or return transfer will have to be covered by customer.
Ownership
Out of Line Shop will remain the legal and rightful owner of the delivered goods until full payment has been received.
Warranty for Damaged Goods
Visible damage of received goods or defective items have to be reported in written form (for address see Impressum) to us within seven (7) days after receipt. After the expiration of this time period, the customer is not eligible to make any claims in regard to evidently defective or damaged items.
In case of defective items, customer may demand a replacement or remedial action. If Out of Line Shop fails to replace the item or take remedial action in the case of a severe defect, customer is entitled to revoke the deed of purchase, to reduce the total payment or to demand compensation. The customer is not entitled to transfer these rights to a third party.
Unless explicitly matching one of the statements below, customer is not entitled to make any further claims, regardless of whatever legal reasons. Out of Line Shop can, thus, not be made eligible for any damage that was not explicitly inflicted to the delivered items themselves, especially not for any sort of financial loss or missed personal gain. In those cases where Out of Line Shop cannot be made liable, the same applies in regard to personal liability of its employees, representatives or assistants.
Said limitation of liability does not apply in cases where a damage results from dire negligence or where a bodily injury occurs. It also does not apply if a customer can make a claim according to §§ 1, 4 of the German product liability law (Produkthaftungsgesetz.)
Should Out of Line Shop violate one of its contractual duties, the duty of replacement shall not exceed that of a typically inflicted damage.
In case the customer is seeking a replacement, he will have to return the items he wishes to have replaced within a time limit of 30 days to Out of Line Shop. If the items that were replaced are not delivered to Out of Line Shop within this time limit, Out of Line Shop is entitled to demand payment for said items and to debit the given bank account for the sum total.
The period of limitation is 24 months, starting from the date of delivery.
Personal Information and Details
All personal information we receive from you will assist us in steadily improving the contents of the Out of Line Shop. We employ these details for the handling of orders, the delivery of goods and the improvement of our service. We will also use your details to communicate with you about orders and products, as well as to keep our data and customer accounts up to date.
Applicable Law
German Law is applicable, without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. The basis of legal operations is Berlin.
Privacy
All personal details or information relating to your person that we have stored on our computers will be handled with absolute discretion and shall not be passed on to other companies or institutions.
Other
This agreement shall be governed by and construed in accordance with the laws of Germany and all legal without giving effect to any principles or conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
